These Terms and Conditions (the “Terms”) apply to your use of turboremancenter.com (the “Site”) and to every order request you send us through it. The Site is operated by Turbo Reman Center, Inc., 643 W Colfax St, Palatine, IL 60067 (“Turbo Reman Center”, “we”, “us” or “our”). By using the Site or sending us an order request, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our products
We sell remanufactured and new turbochargers, turbo actuators, fuel injectors and turbo parts for diesel engines. Photos are for illustration; the part you receive may differ in color, labels or packaging. Part numbers, engine models and applications are listed to help you find the right part. You are responsible for confirming that a part fits your engine; we are glad to help you check this when we call you to confirm your order.
2. How ordering works
The Site does not take payments. When you place an order on the Site, you send us a request to buy the listed products. We then contact you by phone or e-mail to confirm the part, fitment, price, availability and how you will receive the part. A sale is made only when we confirm your order and receive your payment. Until then, either of us may cancel the request at no cost. We may decline or cancel a request, for example if a product is unavailable, a price or description on the Site is wrong, or we suspect fraud.
3. Prices
Prices are in U.S. dollars. They do not include sales tax, core deposits or delivery costs, which we confirm with you before you pay. Prices may change at any time. If a price on the Site is wrong, we will tell you the correct price before you pay, and you may cancel.
4. Payment
Payment is arranged when we confirm your order, using the payment methods we offer at that time. We do not ask for or store payment card details on the Site.
5. Delivery and pickup
How you receive your part is agreed when we confirm your order. Any delivery dates we give are estimates. Title and risk of loss pass to you when the part is handed to you or to the carrier you or we arranged. Please check the part when it arrives and tell us promptly about any damage in transit.
6. Core deposits
Some remanufactured parts are sold with a core deposit, which we tell you about before you pay. The core deposit is refundable. After you send us your original part (the core) and we inspect it, we refund the core deposit to you. We will explain what the core must include and how to send it when we confirm your order.
7. Returns
You may return any of our products within 30 days of purchase, no questions asked. Please contact us before sending a return so we can arrange it. We refund the purchase price after we receive the returned product. Core deposits are handled as described in section 6.
8. Warranty
We offer a warranty on all products we sell. The warranty period for your part is confirmed with your order. If a part fails during the warranty period, contact us. We inspect the part to find out what went wrong. If the failure was caused by a defect in materials or in our workmanship, we will repair or replace the part, or refund its price, at no cost to you.
The warranty does not cover failures caused by incorrect installation, lack of oil or contaminated oil, oil or air restrictions, foreign objects entering the turbocharger, other engine faults, modifications, accidents or misuse. To protect your new part, have it installed by a qualified technician and have the cause of the original failure found and fixed.
Except for this warranty, and to the extent permitted by law, our products are sold without other express warranties. Any implied warranties, including warranties of merchantability and fitness for a particular purpose, are limited to the length of our warranty. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, such as vehicle downtime, towing, rental costs, lost income or lost profits, arising from the Site or from products you buy from us. Our total liability for any claim related to a product is limited to the price you paid for that product. Nothing in these Terms limits liability that cannot be limited by law.
10. Using the Site
You may use the Site only for lawful purposes. Please do not interfere with the Site, try to access it in unauthorized ways, or copy its content in bulk. The text, photos, videos and design of the Site belong to us or to those who licensed them to us. Manufacturer names and logos, such as Cummins, Volvo, PACCAR, Detroit Diesel, Caterpillar and Ford, are trademarks of their owners and are used only to identify the engines our parts fit. We are not affiliated with or endorsed by these manufacturers.
11. Other websites and services
The Site links to or shows content from other services, such as Google Maps, YouTube, Facebook and our Google Business Profile. Those services are run by other companies under their own terms and privacy policies, and we are not responsible for them.
12. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute related to these Terms, the Site or our products will be heard in the state or federal courts located in Cook County, Illinois, unless the law requires otherwise.
13. Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. The Terms in effect when you send an order request apply to that order.
